BOOTH RENTAL AGREEMENT
This Agreement is made between Salon (landlord) (Salon address), the "Salon", and Booth renter / stylist (tenant), a licensed cosmetologist/barber (license no. Cosmetology / barber license number), the "Tenant", regarding the rental of Workstation description at the Salon, beginning Term start date.
1. PREMISES AND RENT 1.1. The Salon leases Workstation description to the Tenant for rent of Rent amount, paid Rent frequency. Rent basis: Rent basis. 1.2. Amenities included in the rent: Amenities included in rent.
2. INDEPENDENT CONTRACTOR STATUS 2.1. The Tenant is an independent business operator, not an employee of the Salon. The Tenant sets the Tenant own service prices, collects payment directly from the Tenant own clients, purchases the Tenant own products and supplies, and maintains the Tenant own client records and appointment book. 2.2. The Salon does not control the Tenant work schedule, technique, or pricing. This genuine operational autonomy is a key factor under state independent-contractor tests — for example, California allows booth rental to qualify as independent-contractor status under the "ABC test" only where the Tenant operates with full autonomy from the Salon. A separate booth-renter license or registration may also be required in some states. 2.3. The Tenant books and manages the Tenant own appointments and client list, using the Tenant own booking system and contact details.
3. LICENSING 3.1. The Tenant represents that the Tenant holds a valid, current cosmetology/barber license (no. Cosmetology / barber license number) and any separately required booth-renter registration in the Tenant state, and will maintain them for the full term of this Agreement. 3.2. The Tenant sanitizes tools, implements, and the workstation in accordance with the rules of the state board of cosmetology, keeps the workstation clean and free of hazards, and is responsible for any citation arising from the Tenant own practices.
