4. RETENTION AND BURDEN OF PROOF 4.1. This record, and the equivalent record for every day worked, must be retained for 3 years. In the absence of adequate records, the burden of proof in a Workplace Relations Commission ("WRC") complaint shifts to the employer to show compliance with the Organisation of Working Time Act 1997. 4.2. ⚠️ Working time records are the document most commonly requested in a WRC inspection, and incomplete records are the most commonly found breach.
