ALLERGEN INFORMATION NOTICE (CARTA DE ALÉRGENOS) (Regulation (EU) No 1169/2011 "INCO" + RD 126/2015)

Establishment: Business (establishment) name Item: Dish / product name

1. LEGAL BASIS 1.1. Regulation (EU) No 1169/2011 on the provision of food information to consumers ("INCO") requires that the presence of any of the 14 regulated allergens be communicated to the consumer. 1.2. RD 126/2015 implements this in Spain for non-prepackaged food (comida no envasada, incl. restaurant, bar, hotel breakfast buffet and food-shop items): WRITTEN information must be available BEFORE the customer orders, listing the allergens actually present in each dish.

2. THE 14 REGULATED ALLERGENS 2.1. Cereals containing gluten (wheat, rye, barley, oats, spelt, kamut) · Crustaceans · Eggs · Fish · Peanuts · Soybeans · Milk (including lactose) · Tree nuts (almonds, hazelnuts, walnuts, cashews, pecans, Brazil nuts, pistachios, macadamia) · Celery · Mustard · Sesame · Sulphur dioxide and sulphites (>10 mg/kg or mg/L) · Lupin · Molluscs.

3. ALLERGENS PRESENT IN THIS ITEM 3.1. Allergens present

4. FORM OF INFORMATION 4.1. Form of information (forma de información) 4.2. ⚠️ Information must be accessible to the customer BEFORE ordering — "ask your server" alone, with nothing written available, does not satisfy the requirement. A QR-code menu with allergen data attached to each dish is an efficient way to meet this obligation.

5. STAFF READINESS 5.1. Staff training note

6. RESPONSIBILITY AND UPDATES 6.1. Responsible person: Person responsible for keeping this up to date. Last updated: Last update date. 6.2. ⚠️ Update this notice immediately whenever a recipe or supplier changes — an out-of-date allergen notice is one of the most common findings during Sanidad/Consumo inspections.

— — — ⚠️ This is a boilerplate template, not legal advice. Spanish employment, consumer-protection and data-protection law (Estatuto de los Trabajadores "ET", the applicable PROVINCIAL convenio colectivo de hostelería/comercio, the sector-wide ALEH VI framework agreement, RGPD/LOPDGDD 3/2018, Regulation (EU) No 1169/2011 "INCO") is highly procedural, includes fixed statutory calendars and changes frequently — statutory figures (SMI, convenio pay tables, LISOS sanction amounts) are re-indexed periodically. Have this document reviewed and adapted by a Spanish employment/legal advisor (abogado laboralista / gestoría) and verified against the current provincial convenio and rates before use. In Catalonia, under the Codi de consum de Catalunya (Ley 22/2010, art. 128-1), documents intended for consumers — price lists, terms of sale, mandatory notices — must be available at least in Catalan; where a Catalan-language version of this document is also used, that version prevails in case of conflict for consumers in Catalonia.
