Minijob Employment Contract (Minijob-Arbeitsvertrag, €603/month)

Employment contract for a marginal, low-wage "Minijob" position — registration with the Minijob-Zentrale (Knappschaft-Bahn-See) is mandatory and the monthly earnings cap and hourly rate must both stay within the statutory Minijob thresholds, which are formula-linked to the Mindestlohn.

MINIJOB EMPLOYMENT CONTRACT (MINIJOB-ARBEITSVERTRAG)

Between: Employer name, Employer address, the "Employer", and: Employee name, Employee address, the "Employee". Contract date: Contract date. Start date: Start date.

1. NATURE OF THE ENGAGEMENT 1.1. The Employee is hired for the position of "Position" as a marginally employed "Minijobber" within the meaning of § 8 SGB IV. 1.2. Typical weekly schedule: Typical weekly schedule

2. PAY AND STATUTORY CAPS 2.1. Gross hourly rate: Gross hourly rate — must not be below the statutory Mindestlohn (€13.90/hour for 2026, rising to €14.60/hour from 1 January 2027). 2.2. Maximum hours per month: Maximum hours/month — kept low enough that, at the applicable hourly rate, monthly earnings do not exceed the Minijob-Grenze. 2.3. Monthly earnings cap: Monthly earnings cap (statutory Minijob-Grenze €603/month for 2026, annual limit €7,236). ⚠️ The cap is formula-linked to the Mindestlohn (roughly 130 × hourly minimum wage ÷ 3) and rises when the Mindestlohn rises — re-check both figures every year, including the scheduled 2027 Mindestlohn increase. 2.4. Other employment/minijobs — the Minijob-Zentrale sums earnings across ALL of an employee's minijobs; exceeding the combined cap converts the engagement into a regular, fully social-insurance-liable job retroactively.

3. REGISTRATION WITH THE MINIJOB-ZENTRALE 3.1. This employment must be registered with the Minijob-Zentrale (Knappschaft-Bahn-See) before or at the start of work.

4. PENSION INSURANCE 4.1. Statutory pension insurance

5. NACHWEISGESETZ (NachwG) PARTICULARS 5.1. This contract also serves as the § 2 NachwG written statement of essential employment terms; see the general Employment Contract template for the full particulars list. ⚠️ If this Minijob is in the Gaststätten- und Beherbergungsgewerbe (restaurants/hotels) or another § 2a SchwarzArbG sector, this document must be issued and signed on PAPER (Schriftform), not merely by e-mail.

6. WORKING TIME RECORDING 6.1. Minijob working hours must be recorded within 7 days and retained for 2 years, under § 17 MiLoG — see the separate Working Time Recording template/log.

— — — ⚠️ This is a boilerplate template, not legal advice. German employment, consumer-protection, data-protection and workplace-safety law (BGB, Nachweisgesetz "NachwG", ArbSchG, MiLoG, SGB IV, DSGVO/BDSG, DDG, EGBGB Art. 246a) changes frequently and includes sector-specific exceptions — notably § 2a Gesetz gegen Schwarzarbeit "SchwarzArbG", which keeps the Gaststätten- und Beherbergungsgewerbe (restaurants and hotels) on paper-only Schriftform even after the BEG IV digitalisation reform. Statutory figures (Mindestlohn, Minijob-Grenze) are re-indexed periodically — have this document reviewed and adapted by a German employment/legal advisor (Rechtsanwalt/Steuerberater) and verified against the current rates before use. Where a German-language version of this document is also used, that version prevails in case of conflict.
